ASSUMPTION OF RISK & AGREEMENT TO HOLD HARMLESS

I UNDERSTAND THAT OWNERSHIP OF A DOG IS NOT WITHOUT RISK OF INJURY OR DAMAGE TO MYSELF, MY FAMILY, OR ANY PROPERTY TO WHICH THE DOG MAY BE EXPOSED, AND INASMUCH AS DALMATIAN RESCUE OF COLORADO INC., HEREINAFTER "DALMATIAN RESCUE", AND THE FOSTER PARENT, ________________________________, HAVE SERVED SOLELY IN A REFERRAL CAPACITY IN MY ACQUISITION OF THE DOG DESCRIBED BELOW:

I hereby release from any and all responsibility and agree to hold harmless the aforementioned parties and agree to personally assume all risk for any injury or damage caused by the aforementioned dog.

Although care is given to the physical condition and temperament evaluation of every dog that comes into Dalmatian Rescue, no warranty is made as to the physical condition of the dog. The Adopting Party assumes full risk and responsibility for the dog. As of the date of this Contract, the Adopting Party assumes responsibility for the dog's actions and shall hold Dalmatian Rescue harmless for any claims arising there from.

I certify that this dog is being acquired as a family pet and will not be resold, given or otherwise transferred to any wholesaler, research facility, or any other person. If the dog is intact, I agree to place with Dalmatian Rescue a refundable spay/neuter deposit of $200 and also agree to have this dog spayed or neutered within 14 days of the date of this agreement (or at a time when the dog is of age for the surgery). I understand that this refundable spay/neuter deposit will be returned to the Adopting Party upon receipt of proof of spay/neuter surgery by Dalmatian Rescue. I agree to maintain this dog in good physical condition, provide appropriate veterinary care, keep my current identification; Dalmatian Rescue ID tag; microchip tag and collar on the dog at all times, and to keep this dog safely confined on my property. This dog is not to be left outside without a proper dog house with a door, nor at night or during cold weather (50 degrees or below) without adequate, HEATED shelter. Neither is the dog to be tied, chained, or attack trained, nor transported in an open pickup bed. I agree to keep this dog a minimum of 30 days to assure proper adjustment.

If, at any time during the life of this dog, I can not keep this dog for any reason, I agree to contact and return the dog to Dalmatian Rescue of Colorado, Inc., (303-281-8963 or 970-226-2844) at a location designated by Dalmatian Rescue of Colorado, Inc. I will not take this dog to any animal shelter, have this dog euthanized (except for old age), nor sell or give this dog away without expressed written permission from Dalmatian Rescue of Colorado, Inc.

Any material and/or substantial breach of this agreement shall entitle Dalmatian Rescue to retake possession of the dog. The agreement shall be binding upon any person in whose possession the dog may be found.

Provide this contract and your tax deductible donation of $150 to the foster parent at the time of adoption. This will enable us to continue our rescue efforts. If you wish to contribute more, both Dalmatian Rescue and the dogs will be forever grateful.
